M CUBE Cordless Power Tools – Warranty Terms and Conditions

Plain-language summary is provided within each section for transparency. If any clause appears to conflict with the summary, the formal clause governs. This warranty applies to M CUBE cordless power tools only.

1. Warranty Period and Territorial Application

  • 1.1 The warranty period is 12 (twelve) months from the original date of purchase as stated on a valid proof of purchase (invoice or receipt).
  • 1.2 This warranty applies only to products purchased from Würth South Africa or its authorised resellers and used within the Republic of South Africa.
  • 1.3 The warranty is granted to the original purchaser and is non-transferable unless required by applicable consumer law for personal consumer transactions.
  • 1.4 If the product is replaced under warranty, the replacement does not restart the 12 month period; the original period remains applicable (unless a specific written exception is issued by Würth South Africa).
  • 1.5 Demonstration units, samples, or pilot units may carry different terms if explicitly stated in writing at the time of supply.

Plain-language: 12 months from purchase, valid in South Africa, for the original buyer. Replacement does not restart the clock.

2. Definitions

For clarity:

  • “Manufacturing defect”: A fault resulting from factory error, incorrect assembly, or defective materials—not caused by misuse, environmental exposure, or wear.
  • “Normal, intended use”: Operation per the user manual, specification sheet, duty cycle ratings, and with compatible accessories (M CUBE batteries/chargers).
  • “Wear items”: Components that naturally degrade through normal operation—e.g., brushes, bearings, seals, switches, chucks.
  • “Overload”: Use beyond the tool’s rated capacity, duty cycle, or thermal limits, including sustained operation causing overheating or strain beyond the intended design.
  • “Unauthorised repair/modification”: Any opening, adjustment, repair, or alteration by persons not approved by Würth South Africa.
  • “Dust ingress”: Accumulation of dust/particles (including metal dust) inside the tool or electronics due to environmental exposure or inadequate maintenance.
  • “DOA” (dead on arrival): Product fails to operate correctly on first use out of the box.

3. Scope of Warranty Coverage (Manufacturing Defects Only)

  • 3.1 This warranty covers manufacturing defects as outlined below, provided all conditions in Section 4 are met:
    • Motor defects: Premature motor failure, uneven running, or internal short circuits not caused by overloading or contamination.
    • Electronics faults: PCB failure, trigger malfunction, or sensor issues arising under normal, intended use.
    • Gearbox defects: Abnormal whining, gear slippage, or internal breakage not linked to misuse or overload.
    • Assembly defects: Loose internal wiring, poorly fastened housings, factory misaligned components.
    • Material defects: Cracked housings without impact marks, defective switches, defective solder joints.
    • Battery charger manufacturing defects: DOA charger electronics or incorrect output voltage upon first use under normal operating conditions.
  • 3.2 Coverage applies only when the tool:
    • Has been operated exclusively with Würth M CUBE batteries and chargers.
    • Shows no signs of overload, impact, water/liquid exposure, excessive dust contamination, or use with incorrect accessories.
    • Has been used in accordance with manual instructions and duty cycles.

Plain-language: The warranty covers factory faults. It does not cover damage from misuse or environmental exposure.

4. Conditions Precedent to Warranty Validity

To maintain warranty validity, all of the following must be met:

  • 4.1 Registration: Register the tool after purchase (via Würth’s official channels where applicable).
  • 4.2 Approved accessories only: Use M CUBE batteries and chargers exclusively.
  • 4.3 Maintenance: Keep ventilation slots clean; prevent dust accumulation; perform routine care per the manual.
  • 4.4 Usage discipline: Do not force the tool into overload; allow cooldown intervals during heavy use.
  • 4.5 Storage: Store the tool dry; protect electronics from liquids and metal dust; avoid corrosive or conductive environments.
  • 4.6 Completeness on return: Return the tool complete, with proof of purchase, and all accessories supplied with the unit for assessment (including batteries/charger where relevant).
  • 4.7 Serial integrity: Serial numbers, labels, and identifiers must be intact and legible; altered or missing identifiers may void the warranty.
  • 4.8 Firmware/software (if applicable): Any software/firmware must not be altered or replaced with non approved versions.

Plain-language: Register, use approved batteries/chargers, keep it clean, avoid overload, store dry, and return complete with proof.

5. Exclusions – What Is Not Covered

The warranty does not cover:

  • 5.1 Wear items: Brushes, bearings, seals, switches, chucks—normal wear and tear is excluded.
  • 5.2 Battery ageing: Gradual reduction in battery runtime due to normal ageing/cycle life.
  • 5.3 Overload/misuse: Overheating, duty cycle exceedance, or operation beyond rated capacity.
  • 5.4 Non Würth accessories: Use of batteries/chargers not supplied by Würth.
  • 5.5 Dust/liquid ingress: Electronic damage from dust (including metal dust) or liquids; corrosion or contamination.
  • 5.6 Impact/drop damage: Cracked housings or broken parts with visible impact marks, deformation, or signs of shock.
  • 5.7 Opening/tampering: Evidence of opening, modification, or repair by unauthorised persons.
  • 5.8 Self modification: Alterations to the tool or batteries, including firmware/software (where applicable).
  • 5.9 Environmental/abusive conditions: Exposure to extreme temperatures, chemicals, solvents, salts, conductive debris, or rain/water immersion.
  • 5.10 Incorrect accessories/consumables: Use of inappropriate bits, cutters, or attachments causing stress/damage.
  • 5.11 Cosmetic damage: Scratches, dents, or discolouration that do not affect functionality.
  • 5.12 Accidents, theft, loss, or force majeure.
  • 5.13 Grey imports/counterfeit: Products not sourced through Würth South Africa or its authorised channels; counterfeit or altered products.
  • 5.14 Non tool items: Carry cases, packaging, promotional items, and non functional accessories unless defective at delivery.

Plain-language: Normal wear, ageing batteries, misuse, non Würth accessories, contamination, impact, tampering, and non authorised products are excluded.

6. Warranty Remedies

  • 6.1 If a claim is approved, Würth South Africa will, at its sole discretion:
    • Repair the product, or
    • Replace the product with the same or equivalent model.
  • 6.2 Refunds are not provided under this warranty unless required by applicable consumer law in circumstances where repair or replacement is not possible within a reasonable time.
  • 6.3 Replacement may be with new or service exchange/refurbished parts meeting original specifications.
  • 6.4 The remedy is limited to the product itself; no coverage is provided for ancillary cost, consequential damages, downtime, loss of production, business interruption, loss of data, or similar indirect losses.
    • 6.5

    Repaired/replaced items continue under the original warranty period (see 1.4).

Plain-language: We repair or replace if covered; no cash refunds unless the law requires and no compensation for indirect losses.

7. Warranty Claim Process

  • 7.1 Initiation: Contact your nearest Würth South Africa branch or authorised service centre.
  • 7.2 Documentation: Provide proof of purchase, tool serial number, and a description of the fault, including operating conditions and accessories used.
  • 7.3 Return condition: Return the complete tool, batteries, and charger (where relevant), in reasonably clean condition, to enable technical assessment.
  • 7.4 Inspection: Würth technicians will conduct diagnostics to determine whether the fault is a manufacturing defect and whether all conditions in Section 4 are satisfied.
  • 7.5 Outcome: You will be notified in writing of approval or rejection with reasons.
  • 7.6 Turnaround: Standard turnaround times may vary; reasonable efforts will be made to expedite.
  • 7.7 Costs: Where a claim is approved, reasonable inbound shipping to the service centre may be covered at Würth’s discretion. Where a claim is not approved, assessment and transport costs may be charged.

Plain-language: Start a claim with proof and the tool; we inspect and confirm. Approved claims may have shipping covered; rejected claims may incur costs.

8. Specific Notes: Batteries and Chargers

  • 8.1 Batteries
    • Must be M CUBE and matched to the tool specification.
    • Runtime reduction over time is normal ageing and not covered.
    • Physical damage, swelling, deep discharge from misuse, or contamination is excluded.
    • Charge cycles must follow the manual (avoid continuous high heat operation; allow cooldown).
  • 8.2 Chargers
    • Must be Würth M CUBE chargers.
    • Manufacturing defects such as DOA or incorrect output on first use are covered.
    • Damage from surges, incorrect voltage supply, dust/liquid ingress, or non compliant adapters is excluded.

9. User Responsibilities (Clarity to Prevent Misuse)

To avoid misrepresentation and ensure proper use:

  • Read and follow the user manual and safety instructions.
  • Observe duty cycles, rated capacities, and cooling intervals.
  • Use correct accessories; avoid binding, stalling, or excessive torque beyond rating.
  • Clean ventilation; avoid metal dust and liquids; store the tool dry.
  • Do not open, alter, or repair the tool yourself.
  • Use only Würth M CUBE batteries and chargers.
  • Keep proof of purchase and ensure serial labels remain intact.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Würth South Africa’s liability under this warranty is limited to repair or replacement of the product.
  • Würth South Africa is not liable for indirect, incidental, or consequential damages (including downtime, lost profits, or business interruption).
  • Nothing in this warranty excludes or limits liability where such exclusion or limitation would be unlawful under applicable consumer protection laws.

11. Interaction with Consumer Rights

This warranty operates in addition to any non excludable statutory rights applicable to consumers under South African law. Where a conflict exists, statutory consumer rights prevail to the extent required by law.

12. Evidence and Assessment Standards

  • 12.1 Photographs, inspection notes, and test results may be used to assess tool condition (e.g., overload signs, impact marks, contamination).
  • 12.2 Overload indicators include thermal discolouration, internal component stress, commutator/armature damage consistent with excessive duty, gear tooth spall consistent with shock loading, or melted plastics near heat affected zones.
  • 12.3 Impact evidence includes cracked housings with external marks, misaligned frames, fractured mounts, and stress patterns consistent with drop/shock.
  • 12.4 Dust/liquid ingress indicators include corrosion on PCB, conductive debris presence, residue trails, and contamination patterns inconsistent with normal sealed operation.

Plain-language: Our technicians look for objective signs of overload, impact, and contamination.

13. Grey Imports, Counterfeits, and Altered Products

  • Products not purchased through Würth South Africa or authorised resellers, counterfeit items, or products with altered serials/labels are not covered.
  • Würth may request proof of origin to verify authenticity.

14. Professional/Commercial Use

M-CUBE tools may be used in professional settings. However, intensive commercial use must respect duty cycles and thermal limits.

Damage from sustained operation beyond specification is not covered.

15. Data Protection and Records

Personal information collected for warranty processing will be used solely for claim handling, service, quality, and compliance purposes and stored in accordance with applicable data protection requirements.

16. Governing Law and Dispute Resolution

This warranty is governed by the laws of the Republic of South Africa. Disputes arising under or in connection with this warranty may be addressed through Würth’s internal resolution process and, if necessary, through the competent South African courts or applicable consumer dispute resolution forums.

17. Severability

If any provision of this warranty is found unenforceable, the remaining provisions remain in full force and effect.

18. Modifications and Publication

Würth South Africa may update these warranty terms from time to time. The version applicable to a product is the version in effect at the time of purchase, unless a later version is expressly applied in writing.

Annex A – Practical Examples (Non Exhaustive)

Covered examples (manufacturing defects):

  • Tool intermittently shuts down under light load; diagnostic confirms PCB fault without contamination.
  • New charger outputs incorrect voltage on first use (DOA).
  • Motor runs rough at moderate load; inspection confirms internal short not related to overload.
  • Gearbox whining at nominal load; internal gear defect found with no misuse evidence.

Not covered examples:

  • Grinder used continuously at high torque overheats, thermal damage consistent with overload.
  • Dust laden workshop; metal dust found on PCB causing short—contamination excludes coverage.
  • Drill drops from height; cracked housing with impact marks—impact excludes coverage.
  • Battery shows reduced runtime after many cycles—normal ageing.
  • Tool opened by third party; non original parts fitted—unauthorised repair excludes coverage.
